Why this matters
Regulation (EU) 2025/40 places the burden of proof on the economic operator. Compliance is demonstrated through the Annex VII technical documentation and the EU Declaration of Conformity — not through a supplier's word or a generic recyclability claim. If that file does not exist, or does not cover the requirements that apply to your packaging, the packaging is treated as non-conforming even if the material itself is fine.

Common questions
If you place packaging or packaged products on the EU market as a manufacturer, Article 39 of Regulation (EU) 2025/40 requires an EU Declaration of Conformity to be drawn up, backed by Annex VII technical documentation. Importers and distributors have their own verification duties.
Packaging without valid technical documentation is treated as non-compliant. Market surveillance authorities can require corrective action, restrict or withdraw the packaging from the market, and Member States apply their own penalties. Customers and retailers increasingly request the documentation before onboarding.
