Why this matters
Under PPWR, packaging without documentation is non-compliant packaging
Regulation (EU) 2025/40 places the burden of proof on the economic operator. Compliance is demonstrated through the Annex VII technical documentation and the EU Declaration of Conformity — not through a supplier's word or a generic recyclability claim. If that file does not exist, or does not cover the requirements that apply to your packaging, the packaging is treated as non-conforming even if the material itself is fine.
Penalties
Member States set and enforce their own penalties for non-compliance, including administrative fines.
Commercial blocking
Retailers, importers and distributors increasingly refuse to onboard packaging without a Declaration on file.
Retrofit cost
Missing test data and supplier declarations take months to obtain. Discovering the gap late means redesign under deadline.
The most common failure is not a non-compliant material — it is a compliant material with no evidence trail. Supplier statements, artwork files and old test reports rarely map onto the PPWR requirement structure without being reworked.

What people ask before starting
Do I need an EU Declaration of Conformity for my packaging?
If you place packaging or packaged products on the EU market as a manufacturer, Article 39 of Regulation (EU) 2025/40 requires an EU Declaration of Conformity to be drawn up, backed by Annex VII technical documentation. Importers and distributors have their own verification duties.
What happens if the documentation is missing or wrong?
Packaging without valid technical documentation is treated as non-compliant. Market surveillance authorities can require corrective action, restrict or withdraw the packaging from the market, and Member States apply their own penalties. Customers and retailers increasingly request the documentation before onboarding.
Is this certification?
No. We are not a certification body or notified body. We review evidence, identify gaps and prepare documentation. The manufacturer remains responsible for the conformity assessment and for signing the Declaration.
